§ 1 Scope and Provider

(1) These Terms and Conditions (hereinafter referred to as "T&Cs") govern the sale of products by Epamu (hereinafter referred to as "Provider") to you in the version valid at the time of ordering.

(2) Deviating business conditions of the customer will not be recognized unless the provider expressly agrees to their validity in writing.

(3) Please read these T&Cs carefully before placing an order with Epamu. By placing your order, you agree to these terms.

(4) Epamu offers the sale of the following products: household appliances and home and garden items.

§ 2 Conclusion of Contract

(1) Contracts on this platform can be concluded in German. If the platform is available in multiple languages, contracts can also be concluded in those languages.

(2) The offers are directed only at end customers with a delivery address worldwide, although in certain cases restrictions may apply for bulky items. These will be displayed on the respective product.

(3) The customer must be at least 18 years old.

(4) The presentation of goods in the online shop does not constitute a legally binding offer, but merely an invitation to submit an offer by the customer.

(5) The customer makes a binding offer when they go through the ordering process and click on the button "Order with Payment Obligation."

(6) The purchase contract is only concluded when Epamu accepts the order by sending the goods or by sending a shipping confirmation via email.

(7) Orders for larger than household quantities or for commercial resale require the explicit confirmation of the provider.

(8) Your orders will be stored after the conclusion of the contract. If you lose your documents, please contact us via email or phone. We will send you a copy of the order details.

(9) You agree to receive invoices electronically. Electronic invoices will be sent to you via email or made available through your customer account.

§ 3 Prices and Shipping Costs

(1) All prices include the statutory value-added tax. Shipping costs and any shipping surcharges will be displayed during the ordering process.

(2) If the correct price of a product is higher than the indicated price, we will inform you before shipping the goods and ask if you would like to continue the order at the correct price. If the correct price is lower, we will charge you the lower amount and ship the goods.

(3) The prices valid at the time of the order apply.

§ 4 Delivery and Cancellation

(1) Delivery will be made to the address provided by the customer. Information on availability and delivery time of the products is non-binding unless a delivery date has been expressly guaranteed.

(2) If an item is not available, you will be informed immediately. Any payments already made will be refunded promptly.

(3) If a delivery cannot be made due to insufficient access, the customer bears the costs of the unsuccessful delivery.

(4) In the case of prepayment, delivery will occur after the payment has been received. With other payment methods, the goods will be shipped after the conclusion of the contract.

(5) Partial deliveries may occur, provided this is reasonable for the customer. You may receive a separate shipping confirmation for each partial delivery.

(6) You can cancel your order free of charge at any time before the goods are shipped. After shipping, cancellation is only possible within the framework of the right of withdrawal.

§ 5 Customs

(1) For deliveries outside the EU, import duties and taxes may apply, which must be borne by the customer. Customs regulations vary by country.

(2) The customer is considered the importer and is responsible for compliance with the legal regulations of their country.

§ 6 Payment

(1) The customer can pay via PayPal, credit card, instant transfer, or advance payment.

(2) In individual cases, certain payment methods may be excluded.

(3) Cash payments and checks are not accepted.

(4) In online payments, the customer authorizes the provider to debit the amounts due.

(5) In the case of advance payment, the customer must transfer the amount within five calendar days.

(6) In the case of credit card payments, the charge will occur after the goods have been shipped.

(7) In the event of a chargeback, the customer will bear the incurred costs.

§ 7 Set-off and Right of Retention

(1) The customer can only set off against undisputed or legally established claims.

(2) A right of retention can only be exercised if the counterclaim is based on the same contractual relationship.

§ 8 Retention of Title

Epamu reserves the right of ownership over the goods until the purchase price has been paid in full.

§ 9 Warranty Rights

(1) The statutory warranty rights apply to consumers.

(2) For used goods, the warranty period is 12 months unless expressly stated otherwise.

§ 10 Limitation of Liability

(1) Epamu is only liable for damages resulting from intentional or grossly negligent behavior.

(2) This limitation of liability does not apply in cases of injury to life, body, or health, as well as in claims under the Product Liability Act.

§ 11 Right of Withdrawal

(1) As a consumer, you have the right to withdraw from the contract within 14 days without giving any reason.

(2) To exercise your right of withdrawal, you must send us (e.g., by email or post) a clear declaration. You may use the model withdrawal form that we provide.

(3) In the event of withdrawal, you bear the direct costs of returning the goods.

(4) We will refund you all payments we have received from you, including delivery costs (except for the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered), promptly and at the latest within 14 days from the day on which we receive the notification of your withdrawal.

§ 12 Data Protection

(1) We are committed to treating your personal data confidentially and will not disclose it to third parties without your explicit consent unless it is necessary for the execution of the contract (e.g., to shipping companies).

§ 14 Changes to the T&Cs

(1) The provider reserves the right to change these T&Cs at any time. Changes will be communicated to customers in a timely manner.

(2) The modified terms will be deemed accepted if the customer continues to use the services or places an order after the changes have been communicated.
